Terms & Conditions

These Terms govern your use of OurNest (the "Service"), provided by Von Holmes ("we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

OurNest is a shared family hub that includes calendar, chores, groceries, meal planning, group alarms, and messaging features.

2. Eligibility & account

You must be of legal age in your jurisdiction (or have a parent/guardian's permission) to use the Service. You are responsible for activity under your account and for keeping your credentials confidential. You agree to provide accurate information and keep it up to date.

3. Acceptable use

You agree not to misuse the Service, including by:

  • using it for unlawful purposes, fraud, or spam;
  • infringing intellectual property or privacy rights;
  • introducing malware, probing, scraping, or interfering with security;
  • attempting to reverse engineer, resell, or redistribute the Service.

4. Intellectual property

We retain all rights, title, and interest in the Service, including software, documentation, and branding. You retain ownership of content you upload, and grant us a limited license to host and process it solely to provide the Service.

5. Service availability

We strive for high uptime but do not guarantee that the Service will be uninterrupted or error-free.

6. Payments, subscriptions, refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

7. Suspension & termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time via the customer portal.

8. Warranties & liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties. Our aggregate liability for any claim is limited to the fees you paid to us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, except where prohibited by law.

9. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws applicable to Von Holmes' place of business, without regard to conflict-of-law rules.
